Who chooses the notary in Spain?

In principle, the person who pays the notary fees also chooses the notary. This is the buyer. However, purchase contracts for new construction or bank repossessions usually provide a clause whereby the seller chooses the notary, even if the buyer pays the fees. The choice of notary in Spain is of less importance, as notaries only have a limited (control) function.
